Advocacy rooted in intellectual integrity and powerful storytelling.
OUR SERVICES
Our roster of clients includes executives, regulated professionals, skilled tradespeople, high-salaried employees, small to medium-sized employers and non-profit organizations across Ontario.
Employment Litigation
We handle wrongful dismissal actions:
Insufficient termination package for “without cause” dismissals;
“With cause” dismissals;
Unjust dismissals for federal employees;
Unlawful reprisals after complaints of workplace harassment or violence, assertion of rights under the Employment Standards Act or assertion of rights under the Human Rights Code; and
Terminations involving discrimination at work.
We also handle ancillary employment-related disputes:
Employee misclassification issues;
Breaches of restrictive covenants;
Entitlement to unpaid compensation, including company shares; and
Select duty of fair representation applications.
Services for Proactive Employers
While our firm focuses on advocacy, we also provide professional services to proactive employers:
Ongoing employee management;
Drafting of employment documents (offers of employment, termination letters, workplace policies, requests for medical information); and
Legally compliant hiring and terminations.
Complex WSIB Appeals
We handle complex WSIB claims involving:
Commencing and defending right to sue applications;
Entitlement to survivor benefits;
Secondary benefits for psychological impairments;
Occupational diseases;
Attendance at return to work meetings.
Our focus is on assisting the estates of workers, employers, and first responders through their unions.
It is also common for clients to retain us for concurrent legal proceedings that stem from a workplace injury. Given we regularly appear in civil court and at multiple administrative tribunals, clients see a value-add in having one firm represent their interests in all forums.
Advice in Sensitive Workplace Investigations
We advise and represent complainants and respondents in sensitive workplace investigations. We also assist employers who must conduct workplace investigations.
These investigations may involve:
Concurrent criminal proceedings;
Complaints of sexual harassment and violence;
Allegations of misuse of company funds.
We also represent regulated professionals in investigations conducted by regulatory bodies, including:
The College of Nurses of Ontario; and
The Mutual Fund Dealers Association of Canada.
We have also advised regulated professionals who had impending investigations before the Ontario College of Teachers.
